On land market and cadastre

Between 8 and 9 August, 2011, Mr Tymchenko, Head of State Agency of Ukraine on Land Resources, made the following statements:

 

Law "On Land Market" will introduce market circulation of farmland along with clear limitations on the maximum amount of land owned by one person. Depending on the quality of the ground these limitations will make up from 900 to 2000 hectares. Talks about oligarchs and latifundists who will buy up all Ukrainian black soil are not more than talks. The excessive concentration of agricultural land will be impossible. In any case, one person will not be able to own more than 2100 hectares of agricultural land.

In order to prevent monopolization of land it is supposed to block the possibility of buying land on the straw. Agreements for more than UAH 150 thousand are subject to mandatory declaration of sources of funds. Anti-trust tools will be used to block concentration of land by related persons.

Starting from January 1, 2012, all cadastral procedures will be performed according to "one stop shopping" principle. The citizen will not have to beat the thresholds of various institutions and organizations, to waste time in queues. It will be sufficient to apply directly to local Department of the State Land Resources Agency, and a person will get necessary papers within a clear deadline. There will be no queues, corruption and exhaustive waiting.

According to the law, extract from the state land registry shall be presented within the day of application, and all other information of the state land cadastre – within 10 days. Each state cadastral registrar will have a personalized seal and electronic signature, and be will be held personally responsible for timely and accurate provision of cadastral information. Otherwise they will be fined.

With the introduction of land market the State Agency will become manager and administrator of about 10-12 million hectares of land, including: 3 million hectares of arable land, 5 million hectares of land of other agricultural uses, more than 330 thousand of unclaimed land shares and 1.8 million hectares of escheated land.

We are aiming at the highest openness of land market, from the point of view of sellers. Land owners will enjoy full potential of their constitutional right to land ownership, the right of free disposal of property. From the point of view of buyers, land market will be thoroughly regulated and strictly controlled by the state.

Although we set up January 1, 2012, as the official date of opening of agricultural land market, it is clear that some technical and procedural issues of market functioning will be completed by 2015, and absolute filling in of cadastre with land data and information is to be completed by 2020.
