Monopolies infringe upon legal regime of land
State Inspection of Ukraine for Control over Use and Protection of land on November 13, 2009, reports about checks and inspections it has completed at national and local monopolies of Ukraine
Inspection says that during 10 months of 2009 it performed 1875 checks of observance of land legislation by enterprises possessing monopolistic positions in different sectors of the economy of Ukraine. There were found 598 infringements at the area of 21 thousand ha. The total damage calculated amounted to UAH 547 thousand. Inspection applied administrative fines to officials of the said enterprises, submitted petitions on initiation of criminal proceedings and on removal of revealed infringements.
In particular, at enterprises of Ukravtodor (Ukrainian monopoly in the field of road construction) there were found 166 infringements at the area of 18500 ha.
At enterprises of Ukrtelecom (Ukrainian monopoly in the field of telecommunications) there were revealed 91 infringements at the area of 23.2 ha.
At the enterprises of Ukrzaliznytsya (Ukrainian monopoly in the field of railroads) there were disclosed 53 violations at the total area of 1500 ha.
There were also detected 288 violations at the area of 1086.5 ha which have been committed by local monopolies (enterprises entrusted with functions of water supply and water processing, energy generation and supply, gas transportation and supply.
The most wide-spread violations are use of land without proper title, illegal seizure of land plots, scraping and transfer of fertile layer of soil without authorization.
