State Inspection of Ukraine for Control over Use and Protection of Land
State Inspection for Control over land Use and Protection, October 27, 2009:
State Inspection of Ukraine for Control over Land Use and Protection informs about results of its activities for 9 months of 2009. It says that inspectors performed over 81.1 thousands checks of compliance with land legislation and found over 51.3 thousand violations of laws and regulations. They issued 50.1 thousand orders prescribing discontinuation of violations and recovery of damages, drafted 33.3 thousand administrative protocols on application of fines to citizens and officials. In total, over 28 thousand citizens and officials were brought to administrative liability, the sum of fines amounted to UAH 5.565 million (UAH 3.171 has already been paid (57%)).
Inspectors also calculated damages caused by illegal seizures of land plots, use of land contrary to its end-use, illegal stripping of top soil. The damages amounted to over UAH 94.6. There has already been paid only UAH 2.895 million (3%). Inspectors submitted necessary documents to the offices of public prosecutors for mandatory recovery of harm.
Inspectors submitted to the offices of public prosecutors about 5.6 thousand claims on application of measures of prosecutors control and reaction to violators of land legislation. As a result, 182 criminal investigations started.
Inspection makes conclusion that among the most abundant violations there are illegal seizure of land plots, use of land plots without documents confirming rights to land, use of land contrary to its end-use and flouting orders of inspectors. Inspection has also expressed its growing concern about position of bodies of local self-governance towards observance of land laws. These bodies failed to provide any kind of control over land use and protection at respective territories, they ignore orders and submissions of the State Inspection; moreover, often they are the first violators of land laws because they issue acts and decisions on land matters with violation of or disregard to current legislation of Ukraine.
